By creating an account, accessing, or using FOSTER (the "Service"), you ("User," "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. If you are using the Service on behalf of a company or employer, you represent that you have authority to bind that entity, and "you" includes that entity.
FOSTER is a decision-support and reference tool intended to assist qualified industrial maintenance technicians in troubleshooting electrical and mechanical equipment, including but not limited to variable frequency drives (VFDs), programmable logic controllers (PLCs), motor starters, soft starters, and crane automation systems.
FOSTER provides diagnostic guidance based on manufacturer documentation and field-derived troubleshooting logic. It does not replace:
You are solely responsible for determining whether you are qualified to perform any action FOSTER describes, and for following all safety procedures required by your employer and by law.
FOSTER's output is generated by an AI system and is provided for informational and diagnostic-support purposes only. It is not certified engineering analysis, and it is not a substitute for consultation with a licensed engineer, electrician, or other qualified professional where one is required.
You agree to:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JENNINGS VISIONS LLC AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR EQUIPMENT, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL JENNINGS VISIONS LLC'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID JENNINGS VISIONS LLC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. JENNINGS VISIONS LLC DOES NOT WARRANT THAT THE SERVICE'S DIAGNOSTIC OUTPUT WILL BE ERROR-FREE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PIECE OF EQUIPMENT OR SITUATION.
You agree to indemnify, defend, and hold harmless Jennings Visions LLC, its owners, employees, and contractors from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Service; (b) your violation of these Terms; (c) any injury to persons or damage to equipment resulting from actions you took while using the Service; or (d) your violation of any applicable law, regulation, or employer safety policy.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify Jennings Visions LLC immediately of any unauthorized use.
FOSTER may be offered on a free-trial basis followed by a paid subscription. Pricing, trial length, and billing terms are as displayed at the time of signup and are subject to change with notice.
Jennings Visions LLC may suspend or terminate your access to the Service at any time for violation of these Terms. You may cancel your subscription at any time; no refunds are provided for partial billing periods except as required by law.
Jennings Visions LLC may update these Terms from time to time. Material changes will be reflected in an updated "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws principles.
